Are Regulations lawful if they have not been passed by the Legislature?


We are facing a real dilemma. We have 500 000 Provinvial regulations which need to be enforced according to the regulations. Government and non Government agencies have been given policing powers to make sure that these regulations are enforced and followed because police cannot handle all regulatory cases beyond what they already are mandated to do .

More police why not??????

 Government keeps building the infrastructure for more controls to “protect us”. Most MP’s and MPP'”s cannot or do not want to comment on any case that is before the courts.

Lets say a neighbour files a complain against you under a regulation. You can be charged, you can defend yourself and you can be found not guilty. You just went through a nightmare which may be lasted at least 6 months. Under regulatory law you have no recourse. You can only clear your name. You cannot be reimbursed for the losses.

Think about it. Most regulatory cases are triggered by private complains. That means that we have no lawful process anymore where you face the accuser. Under the privacy act you cannot find out who laid a complaint against you. May be nobody complaint. This system creates clearly a total imbalance in respect to justice. It also creates a mechanism where you can be destroyed by a simple phone call to the right agency. Once you are charged under  Provincial Offenses YOU ARE GUILTY unless you can prove yourself to be not guilty. Most people rather plead guilty to a lesser charge than to fight injustice.

The question remains are Regulations lawful or not if they have never been passed by the Legislature.

We are sending our representatives to Queens Park to make sure that we are heard, that we are represented.

How come nobody is screaming bloody murder.

here are some numbers to consider

Since 2004 till today 250 000 new regulations have been implemented in Ontario alone.
                   THAT MEANS ABOUT 41 000/YEAR
                   THAT MEANS ABOUT 112/DAY
                   THAT MEANS ABOUT  4/HOUR
                   THAT MEANS EVERY 15 MINUTES ONE MORE REGULATION IN ONTARIO, WHICH IN FACT HAS NEVER BEEN PASSED BY THE LEGISLATURE.
These are only Provincial regulations. On top of that we still have Federal regulations and Municipal regulations.
                   
We urgently need to review the procedures; who can in fact create regulations? How do regulations get implemented and who implements regulations?
We need to understand to what extend regulations paralyse people’s lives.
We need to expose how regulations are used to create fear and mistrust amongst people.
No regulation should be implemented unless Legislature has full knowledge and voted on them.
Regulations so far never need the approval of the elected officials, that’s why most MPP’s cannot do anything about it.
